Medizinische Forschung an einwilligungsunfähigen Personen. Zur deutschen Diskussion um das Menschenrechtsübereinkommen des Europarates zur Biomedizin
Over the last few years the 1997 Convention on Human Rights and Biomedicine of the Council of Europe has been one of the most controversially discussed documents of law. In Germany the very extensive social and political discussion has focused on the rules governing medical research involving persons unable to give informed consent. This paper attempts to explain the development and the content of the convention and tries to present and evaluate the content of the German discussion generally and with respect to the latest developments in European pharmaceutical law. As a result, the present convention is considered not to be a suitable standard for a comprehensive regulation of medical research in Germany. In particular the rules governing medical research involving persons unable to give informed consent does not provide sufficient legal protection such persons.
