Sterilisation Einwilligungsunfähiger. Ethische Anmerkungen anhand eines Case-Reports
The legal guardian of a mentally disabled man filed an application for sterilization, which was granted by the court. In light of the eugenic laws of the »Third Reich«, the case poses a special ethical challenge. A new guardianship law came into force in Germany in 1992. It defines strict rules for the sterilization of people who are unable to consent. Thus, the number of applications for sterilization is extremely low. In this paper, we discuss the case, taking into account different ethical theories. Our conclusions support the judges decision.
