Das Recht auf Erstellung von Vorausverfügungen aus ethischer Sicht
Today both law and ethics accept the proposition that medical and nursing measures necessarily presuppose (with the exception of emergency cases) a patients informed consent. The German so-called »Patientenverfügungsgesetz« of 2009 makes it possible for every adult to determine by means of a living will what he agrees to or refuses in the event he is incompetent to decide, even if irreversible damage to himself ensues. The basis of this law is respect for human autonomy and the right to self-determination. After clarifying the notion of autonomy as an expression of human subjecthood and as the essential basis for connecting an individual to his fellow human beings, the paper enquires into the limits of the duty of the state to save a life, lays out the responsibilities and limits of authorized deputies and care persons, and argues in favour of a constitutive relation between autonomy and trust.
