Das Beschneidungsgesetz in der Kritik: verfassungsrechtliche Legitimation, Anwendungsprobleme, Reformbedarf
The article gives an overview of the German Law on Circumcision of Male Minors and its constitutional implications. The law is still under strong criticism as well as the constitutional arguments that justify the parents right to circumcision. The constitutional law approach differs due to contrary principles of interpretation: on the one hand the principle of strengthening childrens rights, on the other the principle of respecting the parental prerogative which is still the predominant approach in German legal thinking. Constitutional law disputes especially refer to the problem if circumcision of infants can be realized painlessly. Specific regulations focusing on the problem of anesthesia for neonatal circumcision are recommended.
